Trademark Attorney
We’re looking for an experienced trademark attorney or trademark specialist to assist with responding to a USPTO Office Action.
We recently received a preliminary refusal based on likelihood of confusion due to name similarity. However, the cited mark operates under a completely different business model, industry use, and market application, and we believe the refusal can be successfully challenged with a proper legal response.
What we need help with:
• Reviewing the USPTO Office Action and cited mark(s)
• Drafting a strong, well-supported response arguing dissimilarity in:
• Business model
• Goods/services classification
• Market channels and consumer perception
• Advising on any strategic adjustments (if necessary) to improve approval likelihood
• Filing the response with the USPTO within the required timeframe
Ideal candidate:
• Proven experience responding to USPTO Office Actions
• Strong understanding of likelihood-of-confusion refusals
• Ability to clearly articulate legal arguments in plain language
• Efficient, responsive, and detail-oriented
